New York State Troopers in Ithaca were dispatched to a report of a vehicle in a ditch near West Groton and Bird Cemetery Roads on August 3 at 1:18 a.m. A 911 caller reported that the vehicle's operator, later identified as Justin W. Marshall, age 30 of Newfield, NY, was trying to flag down passing motorists. Troopers arrived and Marshall waved a flashlight at the patrol car and told them he was trying to turn his vehicle when he ended up in the ditch.
After an investigation, he was arrested for DWI with a reported B.A.C. of 12%. Additionally, he received tickets for Failed to Use Designated Lane, Operating Out of Class, Moved From Lane Unsafely and Unsafe Backing. Marshall was processed and released on appearance tickets to the town of Groton on September 4. He was later turned over to a sober third party.
